Part 1: Definitions and Introduction

Welcome to Blicq, the mobile application that revolutionizes your lifestyle experience by allowing you to collect loyalty points and convert them into real cashback. By downloading and using Blicq, you join a community of users who benefit from exclusive advantages with our partners (but not limited to). This service is provided by Blicq (Pvt.) Ltd.

Definitions:

• Blicq refers to the mobile application Blicq App, provided by Blicq (Pvt.) Ltd., which allows users to collect loyalty points/discounts and withdraw or spend them at partner merchants.
• Company refers to Blicq (Pvt.) Ltd., the entity that operates the Blicq application.
• User is a capable individual who meets the requirements of this Agreement, has undergone the registration/authorization procedures, and has unconditionally accepted the terms of this Agreement in accordance with its requirements.
• Blicqs are digital units earned by users following purchases at partner merchants (but not limited to), which can be used to benefit from discounts or special offers, or withdrawn to the customer’s bank account or card.

Part 2: Acceptance of Terms

By creating an account and using Blicq, you expressly and unconditionally accept these terms of use and the associated privacy policy. If you do not agree with these terms, you must not use Blicq.

Your use of Blicq is also subject to all applicable laws and regulations. It is your responsibility to ensure that your use of Blicq remains in compliance with these laws.

We reserve the right to modify or update these terms of use at any time. Your continued use of Blicq after such changes constitutes your acceptance of the new terms. Therefore, we encourage you to regularly review this section to stay informed of any updates.

Part 3: Registration Conditions

Eligibility Criteria:

To create an account and use Blicq, individuals must meet certain eligibility criteria. Users must be at least 18 (eighteen) years old. Additionally, users must reside in a country where Blicq is available, as specified in the application details. Other criteria may include agreeing to specific user agreements relevant to their location.

Registration Process:

To register, users are required to provide accurate and current information about themselves, including but not limited to their name, email address, phone number, and any other details deemed necessary by the application for the creation of an account. Users must agree to keep their account information up to date.

The registration process may also involve verification steps to ensure user eligibility and account security.

Part 4: Blicqs Operation

Earning Blicqs:

Users can earn Blicqs through various activities, such as making purchases at partner merchants, participating in promotions, or completing specific actions within the application as defined by Blicq. The number of points earned may vary based on the activity and the specifics of the ongoing promotion or offer.

Validity and Expiration:

Blicqs earned in Blicq remain valid as long as the application exists and the user’s account remains active.

There is no expiration date for Blicqs, offering users the flexibility to use them at their convenience.

However, Blicq reserves the right to introduce changes to the points system, about which users will be notified accordingly.

Using Blicqs:

Blicqs can be redeemed for discounts, special offers, or products at partner merchants. The application will detail how points can be used, including any restrictions or conditions that may apply, such as minimum thresholds for redemption or specific items eligible for redemption.

Withdrawal Option:

Blicqs can also be seamlessly withdrawn to the user’s bank account or credit/debit card in the local currency of the country where the Blicq app is used.Standard bank fees apply, and Blicq retains a management fee of 5–15% on each transfer.

Part 5: Privacy Policy

Our users’ privacy is of utmost importance. While the detailed practices regarding the collection, use, and protection of personal data are outlined in a separate Privacy Policy document, it’s important to note that Blicq is committed to safeguarding your personal information.

We collect data necessary for the effective operation of the application, including account creation, points management, and communication with users.

We implement a range of security measures to protect your personal information and will not share it with third parties without your consent, except as necessary to provide the service or as required by law.

Part 6: Rights and Obligations of Users

Rights of Users:

• Access and use Blicq in accordance with these terms and conditions
• Earn, redeem, and withdraw Blicqs as per the application’s guidelines
• Access their personal information and request corrections if necessary

Obligations of Users:

• Provide accurate and truthful information during registration and keep this information up to date
• Maintain the confidentiality of their account information and not share their login credentials
• Comply with all applicable laws and regulations while using the application
• Users are prohibited from creating multiple accounts. Each individual is allowed only one account.

Part 7: Modification of Terms

The Company reserves the right to modify these terms of use at any time. Changes will take effect immediately upon their posting within the application or on the Company’s website.

We will endeavor to notify users of significant changes through the application or via email. Your continued use of the application after such modifications will constitute your agreement to the updated terms.

Part 8: Limitations of Liability

The Company is not liable for any direct, indirect, incidental, consequential, or punitive damages resulting from the use or inability to use the Blicq app. This includes, but is not limited to, malfunctions, delays, and the loss of Blicqs due to technical issues or termination of the application. Our liability shall be limited to the extent permitted by law.

Part 9: Intellectual Property

All content within Blicq, including texts, graphics, logos, and software, is the property of IN: S.A., based at 14A rue des bains, L-1212 Luxembourg (Luxembourg), or its content suppliers, and is protected by copyright and other intellectual property laws.

Users are granted a limited, non-exclusive, and non-transferable license to use Blicq solely for personal, non-commercial purposes. Any unauthorized use of the content is strictly prohibited.

Part 10: Resolution of Conflicts

In the event of a dispute arising from the use of Blicq, users are encouraged to contact our customer service initially to seek a resolution. If the dispute cannot be resolved through customer service, it shall be settled in accordance with the laws of Sri Lanka, and the parties agree to submit to the exclusive jurisdiction of the courts located within that jurisdiction.

Part 11: Termination and Suspension of Account

The Company reserves the right to suspend or terminate a user’s account for violations of these terms, including but not limited to:

• Creation of multiple accounts
• Fraudulent activities
• Misuse of the application

Users may also terminate their account voluntarily through the application settings or by contacting customer service.
